The Hiiclub Link User Agreement (hereinafter referred to as "this Agreement") is a legal agreement between you and Hiiclub Link(hereinafter referred to as "we" or "our") regarding the use license and operation management services of this software. You must reach 18 years old to access and sign this Agreement.
By using Hiiclub Link software and services, you are deemed to have read, understood, and agreed to be bound by this agreement. If you do not agree to this agreement, please do not use any Hiiclub Link software or services.
Subject to this Agreement, Hiiclub Link grants you a limited, non-exclusive, non-transferable, personal-only, revocable license to access and use the Software and the Service. You may install, use, display, and run the Software and the Service for non-commercial purposes on end point devices of which you own or have the right to use it. All other rights related to the Software not expressly granted to you under this Agreement shall be ours. If you wish to use other rights to the Software, you must obtain our consent separately.
a. As software independently developed by us, Hiiclub Link provides main services including but not limited to:
i. Hiiclub Link provides you with a registration channel. You have the right to register for Hiiclub Link software and related services. After logging into your account, you can browse and modify your personal information at any time.
ii. You can also browse corresponding content through the Hiiclub Link platform.Please understand and be aware that our services may be adjusted and updated from time to time according to your needs or our operational needs. Please refer to the service functions displayed in real-time on this software webpage or other service interfaces (if any).
b. You understand and agree that during your use of this software and related services, we may push relevant information, advertisements, or brand promotion services to you, and we will display commercial advertisements, promotions, or information (including commercial or non-commercial information) of this software and related services and/or third-party suppliers and partners in this software and related services.
c. You understand and agree that we may suspend, interrupt or stop the provision of this software and this service based on our own business development or the requirements of judicial, regulatory, supervisory and other departments.
a. You may not engage in the following behaviors when using this software and service, including but not limited to:
i. Publish, transmit, disseminate, and store content that violates laws, regulations, policies, social order and good customs, and social morality, such as insult, defamation, violence, violation of religion, etc.; publish, transmit, disseminate, and store misinformation, advertising information, etc. to mislead, deceive, and influence others; directly or indirectly disseminate and pornographic content, display and pornographic materials; promote or display drug-related content, drugs, firearms, or controlled knives; display or promote any content that smokes, drinks, or harms the physical and mental health of performers or others;
ii. Renting, lending, copying, modifying, linking, reprinting, compiling, publishing, publishing software, and similar behaviors.
iii. Jailbreaking, reverse engineering, reverse assembly, reverse compiling, illegally obtaining the content of this software through "spider" crawlers and other means without permission, or attempting to destroy this software in other ways; or using plug-ins, cheating software or unauthorized third-party tools/services to access or interfere with this software;
iv. Copy, modify, add, delete, hook, run, or create any derivative works of this software, this service, or the data released into the memory of any device during the operation of this software, the interaction data between the client and the server during the operation of the software, and the system data necessary for the operation of this software, or increase, delete, or change the functions or operation effects of the software by modifying or forging the instructions and data during the operation of the software, or operate or disseminate the software and methods used for the above purposes to the public, regardless of whether these behaviors are for commercial purposes.
v. Without our written permission, you may grab, count, and obtain relevant search keywords, hit rate, classification, search volume, click through rate, reading volume, and other related data, or make any form of modification to our source webpage or obstruct it through occlusion, insertion, pop-up windows, etc.
vi. Engage in other behaviors that violate laws, regulations, policies, public order and good customs, social ethics, or without our written permission.
b. You may not and you agree not to cause others to copy (except as expressly permitted by this license), disassemble, reverse engineer, disassemble, attempt to export its source code, decode, modify the Hiiclub Link software, any services provided by the Hiiclub Link software, or any part thereof (except as prohibited by applicable law or the terms of the open source component license that may be included in the Hiiclub Link software), or create other derivative works. You agree not to delete, obscure, or modify any proprietary notices (including but not limited to trademark and copyright notices) that may be attached to or contained in the Hiiclub Link software.
a.Hiiclub Link and all related content, including software code, design, logos, and documentation, are the property of the developer or rightful owner and are protected by applicable intellectual property laws, anti-unfair competition laws, and international treaties.
b.All rights, including copyrights, trademarks, and other proprietary rights, are reserved. Users are granted a limited, non-exclusive, non-transferable license to use the software as permitted under the terms of service. Any unauthorized use, reproduction, modification, or distribution is strictly prohibited and may result in legal action.
a. We have the right to show you various information during the provision of this service, including but not limited to authorized prompts, display advertising information, and promotional information, which may appear in the form of system messages or pop-up windows. If you do not agree to receive it, you can cancel the relevant service, which may ultimately lead to the inability to achieve the relevant service functions.
b. When you use this service, the specific content displayed may vary depending on the version of the software you use. You understand and agree that when you use certain versions of this software or enter the relevant pages of the applications we have developed, in order to provide you with a better service experience, you may adjust the installation location, size, UI interface and other necessary information of the applications already installed on your end point device. The specific version we actually provide shall prevail.
c. You fully understand and agree that if you need to register an account when using this software, you are responsible for keeping the registered account info and account password safe, and you are responsible for the actions that occur under your registered account, including any content you post and any consequences arising therefrom.
d. The Hiiclub Link Service may include views, opinions, statements, opinions from third-party individuals or organizations, You should exercise your own judgment on the content you come into contact with when using the Service and assume all risks arising from the use of the Content, including but not limited to risks arising from reliance on the correctness, completeness or usefulness of the Content. The information displayed in the Hiiclub Link Service does not represent our views , we cannot and will not be liable to you for any loss or damage resulting from the foregoing risks.
e. If we discover or receive reports from others that you have violated the provisions of this agreement, we have the right to delete or block the relevant content at any time without notice; suspend or terminate your use of the corresponding account or all services; pursue legal responsibilities and other measures. If you violate the agreement and cause any third-party damage, you shall bear the responsibility yourself.
Hiiclub Link maintains a zero-tolerance policy regarding child sexual abuse and exploitation (CSAE). Any content, behavior, or activity that involves or promotes the sexual exploitation, abuse, or endangerment of minors is strictly prohibited. This includes but is not limited to the sharing, creation, solicitation, or possession of any material involving minors in a sexually explicit or suggestive context.Users who engage in or facilitate such actions will have their accounts permanently suspended and may be reported to relevant law enforcement and child protection authorities. Hiiclub Link actively monitors and reports CSAE-related content in compliance with applicable laws and works in partnership with organizations dedicated to child safety.
In order to better provide you with relevant services and ensure the security of this software, we will provide updates or iterations of this software and related services from time to time (including but not limited to software modifications, software version upgrades, partial function discontinuation, function enhancement, development of new services, software replacement, function improvement, etc.). You can choose whether to update the corresponding version according to your needs. We will also prompt you in an appropriate way (including but not limited to system prompts, in-app letters, announcements, app store update prompts, etc.) where feasible, and you have the right to choose to accept the updated version. Updating to the latest version may improve your User Experience. If you choose not to accept the updated functions provided by Hiiclub Link, you should understand that you may put the software in serious security risks or cause the software to be unusable or unstable. Some functions and services of this software may be limited or unable to be used normally due to the lack of version updates.
a. In order to facilitate your use of Hiiclub Link software and services, this software or service may use third-party software or services, and the results of use or access are provided by the third party (including but not limited to the services and content provided by third parties that you jump to through this software or service, and the services and content accessed by third parties through Hiiclub Link Open Platform, etc.). When you use the software or services provided by third parties in this software, in addition to complying with the provisions of this agreement, you should also comply with the third party's user agreement. We cannot guarantee the security, accuracy, effectiveness, and other uncertain risks of the services and content provided by third parties. To the maximum extent permitted by applicable law, you should bear the relevant risks and responsibilities yourself.
b. Regardless of whether third-party software or services are pre-installed in Hiiclub Link software and services, or whether you have opened or subscribed to them yourself, you understand and agree that we cannot provide any express or implied warranties about the security, accuracy, effectiveness, and other uncertain risks of third-party services and content.
c. If you have any disputes with the third party who provides the software and services mentioned above, you and the third party shall resolve them on your own, and you shall bear the relevant responsibilities.
a.Hiiclub Link may offer optional in-app purchases that provide access to additional features, content, or digital goods. All payments for in-app purchases are processed through the platform’s app store (such as Apple App Store or Google Play), and are subject to their respective terms and conditions. Prices and available items may vary by region and are subject to change at any time without prior notice.
b.By making a purchase, you authorize the applicable app store to charge your selected payment method for the total amount, including any applicable taxes or fees. All purchases are final and non-refundable, except where required by applicable law or explicitly stated otherwise.You are responsible for managing your in-app purchases and ensuring that unauthorized transactions do not occur. If you experience any billing issues, please contact the app store directly.
a.Hiiclub Link may display advertisements, sponsored content, or promotional materials within the app as part of the service. These advertisements may be targeted based on information such as your activity, preferences, and usage patterns, in accordance with our Privacy Policy.By using Hiiclub Link, you agree to receive such advertising and understand that we do not always control the content, accuracy, or practices of third-party advertisers. We do not endorse any advertised products or services unless explicitly stated.
b.Any interactions you have with advertisers, including participation in promotions or purchases of goods or services, are solely between you and the advertiser. Hiiclub Link is not responsible for any loss or damage that may result from such interactions.
c.We reserve the right to change the type, frequency, and placement of advertising within the app at any time.
When you use Hiiclub Link software and services, we may need to collect personal data to provide you with services. We attach great importance to protecting your personal data and have developed the Hiiclub Link Privacy Policy (see "Privacy Policy" for details), which explains the detailed information of how Hiiclub Link collects, uses, stores, transfers, and discloses your personal data. You can also check the details of the "Privacy Policy" in Hiiclub Link-Me-Settings-Privacy Policy, which forms part of this agreement. By downloading, installing, or using this service, you agree to be bound by the terms of this agreement and its Privacy Policy, and we will protect your privacy in accordance with this Privacy Policy.
We have the right to judge whether your behavior complies with the provisions of this Agreement. If you are found to have violated any relevant laws and regulations or any terms and provisions of this Agreement or related rules, Hiiclub Link and its licensors have the right to take measures such as deleting the illegal information, restricting, suspending, and terminating the user's use of this software and service without notifying you, depending on the severity of your violation. At the same time, you will be responsible for your improper behavior.
a. To the fullest extent permitted by applicable law, our software and services are provided on an "as is" and "as available" basis, and we hereby specifically disclaim any (express, implied, or statutory) warranties or other commitments, including (but not limited to) implied warranties, liabilities, or conditions (if any) regarding marketability, fitness for a particular purpose, accuracy or completeness of responses, results, skilled work, virus-free, and negligence-free related to the software and services.
b. This software does not contain any malicious code aimed at destroying your device data and obtaining your privacy information. We will also make every effort to ensure the security, timeliness, effectiveness, accuracy, reliability, and continuous operation of this software and this service. However, due to Prior Art, this software and related services may be affected or interfered with by various unstable factors. We cannot guarantee full compatibility with all software and hardware systems, cannot guarantee that this software is completely error-free or free from any interference, and cannot guarantee that any errors in this software and related services will be corrected. If there are any incompatibility or software errors, please contact us for technical support. If compatibility issues cannot be resolved, you can delete this software. We will not be liable to the maximum extent permitted by applicable law for any losses caused to you.
Within the scope not prohibited by applicable law, in any case, we and our affiliates, senior management, directors, employees, and agents shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages caused by the following reasons, including but not limited to damages for loss of profits, goodwill, loss of use, loss of data, loss of business interruption, or any other intangible losses, regardless of the cause and basis of liability theory (contract, tort, or otherwise). Such reasons include: (1) your use or inability to use this service; (2) unauthorized access or alteration of the content or information you transmit; (3) deletion, damage, or inability to use the content or data you transmit through the use of this service; (4) any third-party actions taken in this service; and (5) any other matters related to this service. Some countries and regions do not allow the exclusion or additional liability for personal injury, incidental or consequential damages, so this limitation may not apply to you. At the same time, our maximum compensation for all your losses shall not exceed the total price you need to pay for the use of this software or service (if it involves paid services) within 12 months before the date of filing a claim.
